Insurance Litigation · Prosthetics Dispute

The prosthesis was quoted at RM3.68 million. The life expectancy behind it was labelled “for entertainment use only.”

Practice Area
Insurance Litigation
Year
2026
Outcome
Prosthesis projection discredited; liability capped at 1/3–50%

In a complex trans-humeral amputation matter, V.P. Nathan & Partners identified that the plaintiff’s RM3.68 million lifetime prosthesis projection rested on a life expectancy figure drawn from a source that expressly disclaimed — in its own documentation — that the data was provided “for entertainment use only.”

V.P. Nathan & Partners exposed this fundamental evidentiary flaw, challenged inflated gig-economy income claims against verified platform records, and advised that liability be capped at 1/3 to 50% given that CCTV footage could not establish whether the vehicles had made contact. The prosthesis projection was discredited and the overall exposure was contained within a defensible range for the insurer.
