A severely injured plaintiff required lifetime home nursing care — and two neurosurgical experts placed her remaining life expectancy at 16 and 34.6 years respectively. The gap between the two figures represented a difference of hundreds of thousands of ringgit in the projected cost of care.
V.P. Nathan & Partners reconciled the conflict to a defensible 23-year multiplier by analysing the methodology and clinical basis behind each expert’s projection, and capped nursing costs at rates that reflected actual market provision rather than the plaintiff’s inflated schedule. The total settlement was RM1.45 million at 50% liability — against a plaintiff demand of RM1.5 million.
