A plaintiff who claimed total incapacity following a road accident was observed by V.P. Nathan & Partners’ instructed surveillance team walking — with a limp — during a period when the plaintiff’s own medical reports stated he was functionally unable to ambulate without assistance.
V.P. Nathan & Partners used the surveillance findings alongside detailed medical analysis to resist escalation of the claim into the catastrophic injury bracket, and to anchor liability at 80% to 90% rather than the full liability the plaintiff was advancing. The claim was ultimately contained well below the plaintiff’s opening demand of more than RM800,000.
